SUMMARY OF THE LAST, BEST AND FINAL OFFER
Article 12, C. Double time would be removed from the contract. All overtime would
be paid at the one and one half time rate.
Article 15 Vacation accrual rates would change:
After 7 years- 120 hours/3 weeks (72 hours for a part-time employee)
After 15 years- 160 hours/4 weeks (96 hours for a part-time employee)
160 hours would be the maximum amount of vacation allowed annually,
20 years of service would no longer be rewarded with a fifth week.
Article 16, B (1) Sick leave:
After six months of continuous employment, a full-time employee will
receive 2 paid sick days. 2 more sick days will be accrued though
the remainder of the year. Thereafter, full-time employees shall
accrue sick leave pursuant to the following schedule:
After two years of full-time service = 5 days per year
After three years of full-time service = 6 days per year
After four years of full-time service = 7 days per year
After five years of full- time service = 8 days per year
Bottom line: sick leave is reduced from 12 days to 8 days per year!
Article 16 Employees on FMLA must use all their sick leave, vacation and other
time off (floaters and comps) before taking leave without pay. This
would apply to employees not on protected leave as well.
Article 21, B The health care premium contribution to the employee would increase
from $342 per month to $372 per month.
Article 21, B (3) No increase to dependent health care premium contribution.
Article 21, D Replace Calpers health care with similar health plans contract directly by
MTS. Replace Calpers retiree health with a flat $100 per month if the
retiree has 20 years of continuous service.
Article 26, A 0% wage increase.
Article 26, B Two tier wage structure for serviceperson hired after ratification.
Step A: $11.00 Step B: $11.50 Step C: $12.00 Step D: $12.50 Step E: $13
Article 31 The term of the agreement would be one year.
Attendance Policy: New Attendance Policy would be adopted that would count each day
absent as an occurrence. The progression of discipline would be:
five days- warning, ten days- a letter of reprimand, fourteen days-
a letter of reprimand and one to five days suspension, eighteen days-
termination.
Upon adoption of the new policy employees with seven occurrences
or less will have their occurrences reduced to zero. Those employees
with eight or more will not be reduced to zero.
Return to Work Program: Employees on leave with work related injuries, whose doctor
has recommended light duty, will be assigned duties other than
their normal work. Compensation will be at 50% of their
current rate of pay and two-thirds of 50% of their current pay
rate, tax free. Hours and assignment is at the discretion of the
employer.
