Negotiations Regarding November 30, 2009 Energy Department Layoff
- District
agrees to extend the effective date of the Energy Department layoff from
December 31, 2009 (as indicated in the November 30, 2009 Resolution) to
March 31, 2010 for all employees that will be released, bumped, or
transferred as part of the layoff; who choose to voluntarily retire in
lieu of being laid off; or who voluntarily resign in lieu of being laid
off.
- In
accordance with District Policy and Procedure 4110 and based on seniority
and grade, employees who have been released and placed on the reemployment
list, will be reemployed in any Energy Department vacancies which occur in
their current job classification during the twenty-four month following
the effective date of the layoff.
- All
bumping rights will be pursuant to District Policy and Procedure 4110 and
based on seniority and grade as of November 30, 2009 (the date the Board
passed the resolution).
- Pursuant
to the November 30, 2009 Board Resolution, employees who are subject to
layoff will remain at their current pay grade until March 31, 2010, when
either their layoff, retirement, resignation in lieu of retirement, or
bump into their new position becomes effective. Employees subject to
the layoff process will not receive any general increase or equity
increase which they may have received on January 1, 2010 but for this
layoff.
- All
eligible employees who retire or employees who choose to voluntarily
resign from the District (and forego rights to be reemployed in the
future) shall be entitled to 1 week of severance for every year of service
provided to the District, capped at 12 weeks of severance, and 6 months of
continued medical coverage, in exchange for a settlement of all claims
against the District.
- All
employees who are released and placed on the reemployment list will
receive continued medical coverage for a period of up to 6 months or until
they are reemployed by the District, whichever is earlier.
- Employees
who are moving work locations from La Quinta to Imperial Valley or from
Imperial Valley to La Quinta as a result of bumping or involuntary
transfer associated with the layoffs will entitled to mileage
reimbursement pursuant to District Policy 1540B for travel between their
current job assignment location and their new job assignment location
between March 31, 2010 through June 31, 2010.
- All part
time positions in the Energy Department will be released prior to March 31,
2010 and, where qualified, employees subject to layoff will be placed into
said part time positions pursuant to District Policy and Procedure 4110.
